How Long Does A Reckless Driving Ticket Stay On My Record

Protecting Your Rights

How Long Does Reckless Driving Stay on My Adult Criminal Record?

Adults have two records: A DMV record and a criminal record. Reckless driving stays on your DMV record for 11 years but on your criminal record forever. In Virginia, you cannot have a reckless driving conviction expunged or removed from your criminal record.

How Long Does Reckless Driving Stay on My Juvenile Record?

Juvenile records are different than adult criminal records. Juvenile records are not accessible to the public generally but they are available to select government agencies and law enforcement personnel including Virginia police officers, prosecutors and judges.

If you have been convicted of reckless driving while you were a juvenile your conviction record will be automatically expunged after you turn 19 years old and 5 years have passed since your conviction.

However, just because your record if sealed or destroyed does not help most people. Most people who are concerned about their criminal record, are concerned because they do not want have to report their conviction on applications. However, just because a record of your conviction is expunged does not mean that you were not conviction. Even if your juvenile record is destroyed you still have to answer application questions honestly when someone asks whether you have ever been convicted of a crime.

How Does A Reckless Driving Conviction on My Record Affect Me?

A criminal record effects different people differently. A criminal conviction for reckless driving is more likely to have serious repercussions if:

  • Your work requires security clearance.
  • You drive a company vehicle for your job.
  • You have a Commercial Driver’s License of CDL
  • You are in the military.
  • You are applying for law school or for admission to the bar
  • You are not a US citizen (especially if you have TPS status)

A criminal record can be a problem when you are young. Young people often do not yet know what kind of career they want. A reckless driving conviction is also inconvenient because when you apply for a job and they ask you “Have you ever been convicted of a crime”? you then have to explain the reckless driving conviction on every application.

Fortunately, there is a lot that can be done with most reckless driving cases to prevent a criminal conviction. Get a free consultation from our reckless driving attorney and find out what can be done for your case: (703) 215-1114.
